Chris Brown's Sentence 'A Pretty Tough Deal,' Legal Expert Says

'Labor service is not gonna be easy,' Peter T. Haven says.

Immediately after Chris Brown's plea deal was announced on Monday (June 22), speculation began as to whether the 20-year-old singer was let off the hook too easily for allegedly assaulting his former girlfriend, Rihanna.

Brown avoided jail time and instead was sentenced to 180 days of labor service in Virginia, five years of probation and was ordered to attend a domestic-abuse program for a year.

In addition to the deal that was reached, Brown was also issued a "stay away" order by the judge hearing the case. According the guidelines of the "stay away," Brown isn't to have any contact with Rihanna during the duration of his probation period. In the event both celebrities appear at a function, Brown is to remain a certain distance away from his onetime girlfriend and Rihanna isn't to contact him either.

Many think Brown received only a slap on the wrist for what he pleaded guilty to, but legal expert Peter T. Haven thinks Brown may have actually gotten more than he bargained for.

"It sounds good on the surface — no jail time — but in many respects, it's a pretty tough deal," Haven told MTV News. "He has to do 180 days of labor service. In California, for instance, we're used to seeing guys in jumpsuits picking up trash on the freeway or weeding. Labor service is not gonna be easy. You have to get up super early, you have to be there almost before the sun comes up and work until 2 or 3 [p.m.]. Then he has to do 52 weeks of sitting in a class for two hours every week. He almost gave up a year of his life — that's an indication that the prosecution probably had a pretty good case and [Brown] really didn't want to do any jail time."

Brown was offered 180 days of jail time as an alternative to labor service, which Haven described as "hot, tough, hard work."

Haven suggested that jail time might have been an easier option for Brown. The singer will be formally sentenced on August 5 and Haven suspects the 180 days may be reduced to a shorter time span at that hearing. A brief sentence could easily be reduced even further for good behavior if Brown did serve time.

"It's not a walk in the park [either way]," Haven explained. "But, say if he did jail time as a part of his plea, he probably wouldn't have served the full term — he probably would have done less. He would have gotten out earlier and the whole thing would have been done. When you're in jail, it's also hard to violate the terms of your probation. When you voluntarily take it upon yourself to take these things on yourself and have to show up yourself, that leaves a lot of room for error."

Further complicating matters is that Brown's 180 days of service could be spread out over years. Meanwhile a short jail stay could potentially be "easier and cleaner," Haven said.

"Some lawyers have recommended jail to their clients," he said. "Because if you screw up, you're gonna get more than just 180 days."

Man, we only had a couple of days to spend in Atlanta last week, but as always, it was very eventful. We got to chop it up with a lot of cats, and although we didn't get a chance to interview these two particular brothers, it was dope seeing Andre and Big Boi together. We need those albums, fellas! In Don't Sleep today, we're gonna put you on to game about T.I.'s fam as well as the new joint by Yo Gotti — he's still buzzin' Down South.

Don't Sleep: Necessary Notables

Mixtape: Greg Hustle

Headliners: T.I. and Greg Street

Co-Starring: An ensemble cast that includes Tip's Grand Hustle family members Young Dro, 8Ball & MJG, Big Kuntry, Bobby Ray and newcomers the Rich Kids.

Show Stealer: Look out for Killer Kill on "Man Up." He stomps out what he calls hip-hop nonsense. "I'm a MC, I don't do R&B/ Please tell these [weak] rappers/ Don't try and sing to me/ Bunch of n---as Auto-Tuning like TLC/ Hopping 'round like the new-school BBD/ Sh-- sickens me."

Essential Info: Tip, we all miss you, but your label has apparently been left in good hands and your artists are holding down the fort. On Saturday (June 20), we had a chance to see the Grand Hustle movement tear down the stage at the Birthday Bash concert in Atlanta, and now the musical clique gets up with Greg Street for a compilation mixtape. Familiars such as Big Kuntry, Young Dro, Yung L.A., Bob, 8Ball & MJG and Killer Mike share mixtape slots with some of Tip's newer artists such as the Rich Kids. Look out for those youngsters — their buzz in the ATL is huge. (Oh yeah — Tip also has some unreleased records on this street CD.)

Mixtape: Cocaine Muzik 3

Headliner: Yo Gotti

Essential Info: Yo Gotti's been dropping a string of mixtapes since his official LP, Back 2 Da Basics, came out in 2006. (We loved that "Gangsta Party" way back when.) Now with a new deal in place through J Records/ Polo Grounds Records, the Tennessee native is ready to start cooking up again. His album will be named Live From the Kitchen.

"It's gonna be a classic album from me and a lot of great producers," Gotti said backstage at the Birthday Bash. "It's a good feeling to move real people — bad women and real dudes. They feel the music, it's personal to them.

"Whoever fits on a song that makes sense, that's who we put on it. I don't base my album on other dudes," he added about guest appearances.

With his business on track, Gotti can concentrate on the lead-in to the project. He just put out the third in his Cocaine Muzik series.

"I got one called 'Newspaper on the Floor,' " he explained. "It's a lot of records that's crazy. I don't save a lot of songs. We put some in the mixtape folders, some in the album folder. DJs come to the studio and go through the folder like a buffet. Get your 10,12 songs, put your tape out."

The Streets Is Talking: News & Notes From The Underground

Tony Yayo is literally on top of New York right now. Standing 15 floors up, ice on his chest, model chick on each arm — who could ask for more?

"We just making movies now," Yayo said. "Shout-out to the whole ThisIs50.com ... Lloyd [Banks] ... We living the life. This is the sh-- Rick Ross rhymes about. We overlooking the city. The Unit is bringing the energy back through the Internet. It's to the point now where you don't have to pay nobody to get on — you could just put it on the Internet and become a star."

Like 50 Cent, Yayo just put out a mixtape — Swine Flu 2: The Pandemic.

"It's called The Pandemic because that's before an epidemic comes," he explained. "The [actual] swine flu has actually turned into an epidemic, so now it's getting crazy. I got Hell Rell on there — you definitely should check out this record. I redid the Drake [song] over — instead of 'Successful,' I did 'What you think I wear a vest for?' I went over the 'Daytona 500' beat with 'Goin In.' Shout-out to Wu-Tang. ... I'm just working."

Rihanna Didn't Want Chris Brown To Get 'Stay Away' Order, Lawyer Says

Donald Etra says the order doesn't allow the onetime couple to have even a distant, cordial relationship.

As part of the plea deal struck by Chris Brown on Monday (June 22), the singer was issued a "stay away" order by Judge Patricia Schnegg that requires the singer to avoid his former girlfriend for the next five years, according to Rihanna's attorney.

Donald Etra told a group of reporters outside the courthouse that his client didn't think the "stay away" order was necessary. Rihanna was previously granted an order of protection against Brown, but the pair briefly reunited at a Miami mansion owned by Diddy following the alleged assault.

Now, however, the two will be required to keep their distance.

Under the guidelines of the order, Etra said the pair won't be able to have even a distant, cordial relationship. Brown cannot contact Rihanna at all, while Rihanna reaching out to Brown would be considered a violation on Brown's part, punishable by law. Should they both appear at an event, Brown would be required to stay at least 10 yards away from his former girlfriend.

Etra said the order was issued for the duration of Brown's five-year probation, although the judge said she would reconsider the issue when Brown is sentenced in August.

Brown pleaded guilty to felony assault charges and will be sentenced to up to 180 days of community service in Virginia. Had he gone to trial, Brown could have faced up to four years and eight months in prison. Brown must also enroll in domestic-abuse courses.

Young Jeezy Explains Lil Wayne, Mary J. Blige Birthday Bash Cameos

'For her to come up and bless me ... it meant everything for me,' the Snowman says.

ATLANTA — Another year, another locker room victory celebration for Young Jeezy. The Snowman stole the show again at the concert he gets most amped up for, Atlanta radio station Hot 107.9's Birthday Bash. In 2008, Young Jeezy brought out Kanye West, The-Dream and Usher. On Saturday, the Snowman did it again, with surprise guests Lil Wayne and Mary J. Blige.

"Mr. Birthday Bash. I said it, I meant it. It's mine," Jeezy told MTV News backstage at the Philips Arena. "The Queen of Hip-Hop Soul, Mary J. Blige. Thank you, baby, for coming through. Me and Mary were at the crib, chopping up some Patrón shots. Then we came through the bash, blew it up. Mary is real big for my career. I was listening to her when I was coming up. For her to come up and bless me for my city, it meant everything for me."

Mary didn't actually perform onstage with Young at the concert, but she did give him a major cosign, dropping several accolades. Weezy got on the mic for "Always Strapped" and "Every Girl." Wayne came all the way from Cali to support his friend. Everyone knows how important impressing the hometown crowd is for Young. He can't come to the Birthday Bash stage with a regular show.

"I did it so many years. Everybody knows my music and everybody knows me," Young said. "So it's about bringing something else to it. I brought Jay-Z one year, Kanye one year, Usher. The list goes on. I am Mr. Birthday Bash, I take that charge."

And no, Jeezy says he doesn't give his special guests too much of a heads-up — at least he didn't this year.

"This is the day before yesterday," he smiled. " 'What y'all doing? Come on.' In this business it's about relationships and who you deal with. I really know these people. I come through in the clutch for them and they do the same. Like, me and Wayne about to go on tour, the whole family will be out."

Young Jeezy and Wayne will be featured on the Young Money Presents: America's Most Wanted Music Festival, which kicks off July 27 in Scranton, Pennsylvania.

Will.I.Am Fires Back At Perez Hilton; Video Of Altercation Hits Web

Perez's decision to Tweet for help instead of calling 911 was a call for 'mad attention,' Will says in new online clip.

The war of words between Perez Hilton and the Black Eyed Peas' Will.I.Am appears to be escalating.

First, after Hilton took to his Twitter account to accuse the BEP mastermind of assaulting him outside a Toronto nightclub, Will posted a video on his Dipdive site, in which he denied having anything to do with harming the celebrity blogger and placed the blame for the incident on an overzealous fan.

Then, Hilton posted a response video of his own — an angry, 12-minute missive in which he painted himself to be the victim of intimidation and violence, called Will "a f---ing liar," and accused Black Eyed Peas manager Polo Molina of punching him "two or three times" in the head.

Now, Will.I.Am has fired back again, with a second Dipdive clip, in which he refutes Hilton's claims, once again stating that he had nothing to do with an assault and accusing the gossip maven of playing up the incident for attention.

"OK, so I'm on my way to sleep, and I get a text from a friend, and it says she reads on Twitter that I assaulted Perez Hilton. For those who were following my Dip [postings], I told you what happened," Will said in the video. "This dude twists it and says I assaulted him, when I was the one who came to him with respect, and he was the one who called me a f----t outside of the club. Whatever. I hit you, Perez? Come on, dude, I didn't hit you. I told you that I didn't like the fact that you disrespected us.

"Dude, apparently you were bleeding outside the club. I was, like, next to you by a tree. I was waiting for my car. And instead of calling the police, you [Tweeted] that I assaulted you. Sounds like somebody wants mad attention and is not really concerned with his health," Will continued. "I didn't hit you. And this is very wrong that you are [Tweeting] that I did that, once again disrespecting me and everything that I stand for. And they're lies. And that's wrong. Shame on you. Shame on your behavior."

Will doesn't actually address Hilton's claim that he was assaulted by Molina, but in a video of the incident — which, of course, surfaced Monday afternoon (June 22) on TMZ.com — Hilton can be seen arguing with a pair of men outside Toronto's Cobra club, one of whom appears to be Will and the other whom the Web site identified as Molina.

Though footage is grainy, Hilton can clearly be heard shouting: "No, you're not a f---ing artist. You're a f---ing f----t." The gathered crowd responds with "Oohs!," and Will can be heard shouting, "Yo, that's Perez! That's Perez Hilton!"

From there, the scuffle apparently breaks out, as club security can be heard ushering partygoers back inside the club. At the end of the clip, someone can be heard yelling, "You just assaulted Perez Hilton."

The Toronto Police Service's Public Information Unit has yet to respond to MTV News' phone calls and e-mails about the incident, nor has a spokesperson for the Black Eyed Peas' label, Interscope Records.

From the time reports first surfaced about an alleged assault involving Chris Brown to the moment the R&B singer struck a plea deal in a California court, MTV News has been bringing you details and developments about the case. Here is the timeline of how events unfolded:

Sunday, February 8: News breaks that the Los Angeles Police Department is investigating a domestic-violence report involving Brown and an unidentified woman in L.A.'s Hancock Park neighborhood early Sunday morning.

Later that same day, Brown voluntarily turns himself in to police for questioning. Reports that the unidentified woman is Rihanna began to trickle out.

Monday, February 9: Brown is charged by the LAPD with making criminal threats. Bail is set at $50,000, and Brown is released from police custody.

Widespread reports identify Rihanna as the victim of the attack and that she suffered visible injuries as a result.

Tuesday, February 10: Rihanna is said to be fully cooperating with police in the investigation. Law-enforcement sources describe Rihanna's injuries as "horrific," and photos of the wounds reportedly show major contusions on both sides of the singer's face, with serious swelling and bruising, including a split lip and a bloody nose, as well as bite marks on one of her arms and several fingers.

Rihanna's grandmother tells a Barbados newspaper, "I don't want people to worry. Rihanna is fine and she is doing well."

Wednesday, February 11: TMZ reports that a text message sent to Brown from another woman about "hooking up later" may have ignited the explosive argument between Brown and Rihanna.

E! News reports that Rihanna told police Brown choked her and left her unconscious following their altercation, where she threw the keys of Brown's rented car out the window, sending him into "a rage." After the incident, police drove Rihanna to the hospital rather than waiting for an ambulance after noticing her eye was black and swollen. E! also reports Rihanna told police that Brown threatened to kill her.

Friday, February 13: Brown's father tells People, "He's reflecting on this situation. He's very remorseful. He's very concerned about the situation, and he wants to make sure that [Rihanna's] OK. This is unfortunate, this stumble, this situation. Hopefully, he will get past it. We all have our shortcomings. We all trip."

Sunday, February 15: Brown releases a statement about the incident. "Words cannot begin to express how sorry and saddened I am over what transpired," the statement reads. "I am seeking the counseling of my pastor, my mother and other loved ones, and I am committed, with God's help, to emerging a better person."

Thursday, February 19: TMZ posts a photograph it claims is of Rihanna shortly after the altercation with Brown. The woman in the photograph is shown with her eyes closed and visible contusions on her forehead, cheeks and mouth.

Friday, February 20: The LAPD launches an internal investigation and files a personnel complaint following the leak. "The Los Angeles Police Department takes seriously its duty to maintain the confidentiality of victims of domestic violence," the LAPD asserted in a statement. "A violation of this type is considered serious misconduct, with penalties up to and including termination."

On her 21st birthday, Rihanna makes her first public statement since the altercation. "At the request of the authorities, Rihanna is not commenting about the incident involving Chris Brown," reads the statement from her representatives. "She wants to assure her fans that she remains strong, is doing well, and deeply appreciates the outpouring of support she has received during this difficult time."

Thursday, March 5: Brown appears in court to be arraigned in the case. The district attorney's office charges Brown with felony assault and a felony count of making criminal threats. At the request of his attorney Mark Geragos, Brown is granted a continuance in the case and his arraignment is been pushed back until April 6. Brown does not enter a plea.

Court documents reveal details about the case against Brown, including a police statement that the incident began when Rihanna found a text message on Brown's cell phone from "a woman who Brown had a previous sexual relationship with."

Monday, April 6: At an L.A. criminal courthouse, Brown pleads not guilty to two felony charges of assault and making criminal threats.

Wednesday, April 29: Geragos tells reporters outside of a Los Angeles courthouse that he wants the case against Brown dismissed entirely due to the leak of the police photo of Rihanna.

Wednesday, May 6: Geragos files a motion asking the LAPD to turn over all the written statements and reports in connection with the department's investigation into the leak of the photo of Rihanna.

Tuesday, June 9: Rihanna is subpoenaed to testify at a preliminary hearing in the assault case against Chris Brown.

Wednesday, June 10: California's Second District Court of Appeal denies Geragos' bid to delay the preliminary hearing in Brown's assault case.

Wednesday, June 17: The California Supreme Court also denies a request by Geragos to delay the preliminary hearing in the assault case.

Monday, June 22: On the day of Brown's scheduled preliminary hearing, a last-minute plea deal is announced between the singer and the state of California. Brown pleads guilty and is sentenced to 180 days of community labor, to be served in his native Virginia.

Rihanna, Not Judge, Should Have Imposed 'Closure,' Abuse Expert Says

Posted: 22 Jun 2009 06:27 AM PDT

'It's difficult when the criminal-justice system gets involved,' Bea Hanson tells MTV News.
By Jayson Rodriguez

NEW YORK — While Chris Brown was the one who was sentenced Monday (June 22) after striking a plea deal, the judge at the hearing also spoke to Rihanna and told her to avoid her onetime boyfriend under a "stay away" order.

According to an abuse expert, the judge's actions send "the wrong message" to victims.

"It's difficult when the criminal-justice system gets involved, because suddenly, the victim is on the sideline," said Bea Hanson, who works at Safe Horizon, an organization in Manhattan that helps abuse victims. "It's really about the abuser, and in this case, you have someone who sounded like she wanted to be with him. And the problem with the 'stay away' is the judge in that case said to her [that] it's as much about her as it is him. And that really sends the wrong message to victims of domestic violence. Because she's not the one that hit him; she was hit. And what it ends up looking like is that this [order] is something against her as well."

Under the guidelines of the order, Brown can't contact Rihanna in any fashion for five years, which is the duration of his probation. Brown isn't even allowed to be in the vicinity of Rihanna during events that both celebrities might attend. According to Rihanna's attorney, Donald Etra, the judge told his client that if she were to contact Brown, it would be a violation against him that could have him facing jail time.

Etra also told media gathered outside of the courthouse following the hearing that Rihanna didn't want the "stay away" order issued against Brown. She thought the previous order of protection was fine.

Hanson said these types of decisions are difficult for any former couple to deal with, but grow larger in domestic-abuse cases.

"The problem here is that closure is imposed by somebody outside the relationship," she said.

In addition to the probation, Brown also has to complete 180 days of community labor and undergo a year's worth of domestic-abuse counseling.

Hanson suggested that Rihanna undergo some type of additional healing process as well, whether it's counseling or a retreat: "Whatever it is for her that makes her feel like a strong woman," she said.

[Chris Brown rises.]

Judge Patricia M. Schnegg: Mr. Brown, what is your full name?

Brown: Christopher Maurice Brown.

Judge: And what is your date of birth?

Brown: 5/5/89.

Judge: All right. In the case number BA353571, you are charged with the felony complaint of assault by means likely to cause great bodily injury in violation of penal code section 245, subdivision A, subdivision 1, which is a felony committed on or about February 7th and February 8th, 2009. Do you understand what you've been charged with?

Brown: Yes, ma'am.

Judge: Your attorney has advised the court that you wish to enter a plea of guilty to that charge. Is that correct?

Brown: Yes, ma'am.

Judge: Before the court can accept your plea, I must advise you of your constitutional rights, and you must understand them and knowingly and voluntarily give up those rights before the court can accept your plea. You have the right to a preliminary hearing. Do you understand that right?

Brown: Yes, ma'am.

Judge: You have the right to a trial either by court or jury. Do you understand that right?

Brown: Yes, ma'am.

Judge: Do you waive and give up your right to a preliminary hearing and trial in this matter?

Brown: Yes, ma'am.

Judge: If you were to have a preliminary hearing or trial, you would have the right to confront and cross-examine the witnesses against you. Do you understand that right?

Brown: Yes, ma'am.

Judge: Bodily injury is a felony in violation of penal code section 245, subdivision A, subdivision 1 on Robyn F. How do you now plead?

Brown: Guilty

Judge: Counsel, do you join the pleas and wagers?

Mark Geragos, Brown's attorney: Yes.

[Brown leaves courtroom.]

[Rihanna enters courtroom.]

Judge: Ms. Fenty, if at that time, you would want me to lift the protective order back to a level one, I would consider doing that, and your attorney knows that he can go ahead and make a motion. ... But the protective order, although it's only one way, it really goes two ways. Because if you contact him — which I don't think you would — then he would be in violation of my court order, which I don't think you would. Now Ms. Murray, who is behind you ... is going to give you a copy of the protective order right now, so let the record reflect that Ms. Fenty has been supplied a copy of the protective order. Thank you so much

Rihanna: Thank you, your honor.

Singer will do 180 days of service; judge issues order for Brown to stay away from Rihanna.

LOS ANGELES — A last-minute plea deal was just announced between Chris Brown and the state of California in the singer's felony assault case for the incident involving his former girlfriend Rihanna, MTV News has learned live from inside the courtroom.

Brown, accompanied by his lawyer, pleaded guilty to the charges, and Judge Patricia M. Schnegg has sentenced him to 180 days of community labor, to be served in the singer's native Virginia.

Both Brown and Rihanna were present in Los Angeles Superior Court on Monday afternoon (June 22) where the "Umbrella" singer was expected to testify. Rihanna had been subpoenaed by the district attorney's office and was expected to break her silence about the February incident that allegedly left her battered and bruised by Brown.

She did not testify, however, and the judge issued a five-year "stay away" order to Brown and said Rihanna would be entering the courtroom once Brown exited.

According to TMZ, Brown's attorney, Mark Geragos, was seen at the courthouse earlier in the day, visiting the judge's chambers to work on the final details of a plea bargain for his client.

A couple of hours later, Brown arrived a few minutes early at the courthouse in a gray suit and tie. Brown was accompanied by family members and offered no words to the media gathered outside. Rihanna's attorney, Donald Etra, entered the courthouse before Brown, and Rihanna was not present at the time, fueling speculation that a plea deal was eminent. Rihanna then entered the courthouse later through a back entryway, wearing dark glasses, according to multiple reports.

As the preliminary hearing began, word of the plea deal was soon announced to the courtroom.

Additional details of the plea bargain were not immediately made available as of press time. A press conference is expected to take place immediately following the hearing.

MTVNews.com will have more details on this developing story soon.

Chris Brown 'Needs A Little Jail Time,' Some Say

Posted: 22 Jun 2009 06:39 AM PDT

'I think he really needs to learn his lesson,' one man tells MTV News in NYC.

Almost as soon as MTV News reported Chris Brown's unexpected guilty plea in his felony assault case stemming from a February altercation with former girlfriend Rihanna, the comments section of the article lit up. Readers obviously had very strong reactions to the development, and we wanted to hear more. So MTV's Tim Kash hit the streets in New York's Times Square to find out what you thought of the deal and how you would have chosen to sentence the singer.

Almost everyone we spoke with was surprised about Brown's plea deal. "I thought with his celebrity status and the lawyers he had backing, he would try and fight it and try and look presentable," said Nate Silverman, adding that he believed the sentence was too light and Brown should have been forced to serve jail time.

Shawn Adams concurred with that assessment. "I think he really needs to learn his lesson," he said. "He needs a little jail time. If you seen what he did to her face — that speaks enough."

Several people would have liked to see Rihanna speak out on the issue of domestic violence during Monday's (June 22) hearing. "I think she should use this for all the teenagers she's a role model for — don't keep your mouth shut," said Dagga Maynard. "If this is happening, go tell somebody."

If Ciara Griffin were in charge of sentencing, she would have come up with something a little harsher than 180 days of community service. "I would put him on every street in America at different times, in the public eye, cleaning up garbage and getting as much abuse as he deserves off people because I think he really deserves the worst," she said. "How dare he do that to Rihanna! She's such a strong woman!"
